Amended Bonita Bay Complaint Cites Fraudulent Fund Transfers
Bonita Bay Group officials allegedly drained the coffers of the company’s communities – leaving members unable to get $250 million in refundable club deposits back.

May 4, 2010 – A revised complaint by the Florida Attorney General’s Office alleges that Bonita Bay Group officials drained the coffers of the company’s communities – leaving members unable to get $250 million in refundable club deposits back.
The new complaint, filed Friday in Lee circuit court, alleges that the company’s action amounted to "fraudulent transfers" because not enough money was left in the clubs to honor Bonita Bay’s 30-day money-back guarantee for members who resigned from the clubs.
The original complaint, filed March 19, says Bonita Bay used deceptive and unfair trade practices in telling members that they could get their deposits back.
……The revised complaint says that Bonita Bay Chairman David Lucas "has admitted under oath that membership deposits paid to the defendants directly or indirectly through subsidiaries for membership in the clubs went into the general revenue of defendant Bonita Bay Group Inc."

Hopefully one of these times the complaint will be ctriminal and not civil. U&ntil they start sending these crooks to jail the fraud will not stop. A 20 year entence would ring load and clear and just then maybe some of these fools will think twice before they frain off funds for their personnal benefit.
