Upcoming Foreclosure Sales in Palm Coast and Flagler County

Only 30% of the residential properties scheduled for foreclosure sales in the next two weeks are homesteaded

Palm Coast, FL – April 26, 2010 – The Flagler County Clerks of Courts office will be busy during the next two weeks. About 75 real estate properties are scheduled to be sold as a result of foreclosure Final Judgments. A search of public records disclosed that most of the affected properties, 70%, are not Homesteaded. In Florida, homesteaded properties designate the owner’s principal place of residence. They are shielded from large increases in assessed value by Florida’s Save Our Homes Amendment which restricts assessment increases to the CPI or 3% whichever is less. Non-homesteaded investment properties and second homes are apparently more likely to suffer from foreclosure.
Nearly all the properties scheduled to be sold are listed below, giving the address or location, followed by the 2009 "Just (Market) Value" from the property appraisers records, then the most recent sale date and price (if available). The letter codes following each entry denote:
N = not homesteaded
Y = homesteaded
V = Vacant building lot
Not surprisingly, nearly all the properties were purchased during the 2002 – 2007 time period at prices well above the current market value. Remember too that the 2009 Just Value is based on 2008 sales. It’s safe to assume that current market value is below that number. Also note the small number of high-end properties listed for sale. During the past six months, there has been a sizable increase in the number of foreclosure (lis pendens) filings against high-end properties, but the foreclosure process is slow. It will be a while before they show up as lender-owned sales. Short sales, however, are already affecting prices in that segment.
The properties below are SCHEDULED for sale. They may be taken off the list at any time up to the time of sale. Typically this is done because of short sales but could occur if the property is refinanced or the owner and lender work out an another agreement.
The sales are held in the Clerk of Courts office. They are public. Lender representatives will be there to protect the lender’s position. While others can bid, they seldom do. Several properties will be disposed of in a matter of minutes.

    Toby,
    You mention that higher-end properties are starting to get Lis Pendens. Chalk it up to morbid curiosity but do you know the price of the most expensive Flager property (residential) that has been served?

    Inspection needed before bid

    These properties are in various states of repair, and should be inspected prior to bidding. The lack of air conditioning, and pest control may have them full of mold and pest. You would also be wise to look for Chinese sheet rock, that could cost more to replace than the property is worth. Some are rented and will be subject to laws requiring the tenant to stay until reasonable time is given for vacating. Rule of thub for distressed properties is the 40th percentile of current market value. Some may justify higher bids, due to condition, but probably not higher than 60th percental of current market value. Forget the just value, as it is an opinion, uninspected, done statisticaly by the County Appraisers.

    All price ranges are affected

    The largest and most expensive house in Flagler County has been in foreclosure the past 2+ years. So far the lender has been unable, or unwilling, to take back the property.

    Toby – What is the story with all of the European Village units up for sale on the 29th?? Several commercial units. Looks like news to me, is the entire place going bust? Thanks

    I don’t know what the highest appraised value is for properties against which lis pendens have been filed. I have noted in several recent newsletters the locations. There have been several in the Hammock area including Island Estates, Hammock Beach, Ocean Hammock, and Hammock Dunes. Some undoubtedly are valued above $1 million.

    The EV units being sold are mostly owned by Peter Roehr. His former partner won a judgment against him. Some are commercial condos and many are parking garage condos – that’s right, parking places in the underground garage.

    I think the blood bath is necessary to clear out those no longer able to participate. Note that some new merchants are moving into the commercial condos.

    There a lots of good places to eat and I like the atmosphere.
