Real Estate Developer Hawk McMillan is Out of the Country

Well Known Palm Coast real estate broker and developer leaves behind a trail of debts and worried investors.

Palm Coast, FL – February 18, 2010 – Well known Palm Coast real estate broker and developer Robert E. (Hawk) McMillan III is "out of the country," according to his attorney, Kevin Donaghy. Donaghy declined to provide information about McMillan’s location or future plans stating, "We have no comment." Phone numbers listed in the Flagler County Association of Realtors

Public records searches reveal a mountain of debt, foreclosures, unpaid property taxes, and at-risk investors totaling several million dollars.

At the top of the list is the Edgewater Harbor project south of New Smyrna Beach on US 1 in Edgewater, FL. The project’s website states the 60-acre Intracoastal Waterway project is permitted for 416 condominium units as well as 100,000 square feet of commercial space comprised of:

  • 60,000 square feet/dry stack marina with 330 dry docks
  • 3,000 square feet for a ship’s store
  • 2.000 square feet smoking bar for slip owners
  • 10,000 square feet restaurant
  • 15,000 square feet of assorted shops

McMillan is listed as the registered agent and Managing Member for the project owner, Edgewater Harbor LLC who purchased the property for about $3,000,000 in 2004. About 20 individuals and couples invested $5 million into Edgewater Harbor LLC. Edgewater Harbor LLC obtained $4.5 million in additional funds through a mortgage from TransCapital Bank. Pre-construction sales efforts stalled when the real estate market tanked and construction was never started. A lis pendens (notice of foreclosure) was filed on September 15, 2009. Unpaid 2008 and 2009 property taxes on the property total $263,696.

McMillan’s Intracoastal Waterway home in the Island Estates section of Hammock Dunes is also in foreclosure as are several other properties owned directly by McMillan or by LLCs for which he is the registered agent and/or managing member. Furniture and appliances have been removed from his home. Unpaid 2008 and 2009 property taxes on the home total $39,085.

    Too Kind

    Geeze Toby… you are too kind to Hawk. Public records indicate the actual numbers all of the debt totals nearly $20 Million dollars and $580K in 2008 & 2009 back property taxes.
    Much of this debt, $10M, came from the pockets of local investors.

    He represents everything that’s wrong with the real estate/finacial situation we’re in. I see he made sure to take his furniture and appliances before screwing his bank out of their money.

    Wow! That’s easy, Flagler counties economic problems are ALL Hawk’s fault. What we fail to mention is that he tried to hold on and to sell anything he owned. He had invested, made and personally lost A LOT of money in Flagler county. It’s sad that some of the local investors lost money, but that’s the risk we take when we invest in real estate.

    No, Flagler Counties economic problems are not his fault. I simply stated "he represents all that is wrong with the situation we’re in". He left in the middle of the night, leaving alot of people holding the short end of the stick. The bank is stuck with his house (after he made sure to take out the appliances), the county is stuck with a huge tax bill and investors lost millions. Yet, somehow I don’t believe he waltzed away penniless.

    Gina, you are uninformed. Hawk didn’t own anything free and clear… he over mortgaged EVERYTHING. The bank is taking the loss.. not him. He never invested his own money … it was "O.P.M." (other people’s money) Investors understand that there is risk… BUT.. failed to see the RISK and having their investment STOLEN. About $6 MILLION dollars of Edgewater Harbor funds are unaccounted for…. as well as other investor funds with other projects. The State Attorney will find the paper trail /money trail leads to him. Honest guys don’t leave the country in the middle of the night.

    I worked for Hawk breifly (found out to much of his goings on)and let me tell you he was Nuts! He drank every 5:00p.m. (at the office it was stocked!) or before if he could! Blew up and screamed at the drop of a hat, said he blamed it on his medication which he didn’t take, and played the field on EVERYTHING! Good Riddance us sooooooooo right him and the other swindler Peter Roehr!!!

    He’s in Panama. Most likely in a development called Tucan just west of Panama City across bridge of the America’s. a friend of his bought a home in there a year or two before he skipped. This is serious comment. Caused me a lot of pain and cost me a ton of money. I would look near there and also on the other side near Bocas del Toro where there is a large expat development

    REMAX DAYTONA HAWKS HUB 1999

    I was FRITZ AND KARINS RECEPTIONIST in 1999, at their REMAX ISB DAB office, where HAWK had an office. All I can say after reading these allegations is: WOW! I remember HAwk! he was always in a rush, I recall, and very busy with listings. I actually more of an admin asst for all the agents there, yet it was a temp job, so I had approached hawk about being his personal asst. He said that he was bringing his son down from Atlanta to hopefully help him, and secondly, that his jealous and demanding girlfriend wouldnt allow him to have an asst thats so good looking as I. WELL, I MUST SAY THAT AFTER READING ABOUT HIS WAYWARD ACTIVITIES, ITS A GD THING I DIDNT GO TO WORK FOR HIM. YET I DO RECOLLECT HIS BEING CHARMING AND WAS VERY HARDWORKING AND RESPECTED BACK THEN. WHERE IS HE NOW? HIS WEBSITE IS UP STILL, YET NOT UPDATED.

    Hawk Not Alone

    Oddly enough, Hawk wasnt the only agent @ the REMAX ISB DAYTONA BCH office to end up spawning negativity. Also back in 1999, another agent there, by the name STAN CROSSLAND, left some unhappy ppl in his wake. A woman at my Doctors offc for one. Upon seeing where I was employed, she asked me if I knew Stan. My reply as I recall was that I did, speaking with him daily at the office and he seemed to be a real nice guy. She then looked at me odd as I recall, then proceeded to tell me of the mess that she and her husband were in as a result of STANs failure to disclose issues to do with the home they bought while he was their agent. Upon hearing this, I recall doing a search that revealed 3-4 more irate clients. I do not, however feel that he was deliberately ambiguous in these dealings, just lazy, and desparate for some sales contracts. Unlike Hawk, who generally came in the office a cppl times a week, mainly in the afternoon, Stan was there almost daily, i.e. he didnt have alot going on listing & salewise, and wasnt very very ambitious. I had heard later that he dropped real estate as a career.
