Tidelands Owners Can Now Have Boat Docks on the Intracoastal Waterway, Cimmaron Canal

Agreement between Home Owners Association and Centex/Pulte reached.

Palm Coast, FL – September 12, 2009 – The Tidelands Home Owners Association (HOA) reached an agreement with Centex / Pulte Homes this week for the return of common property in dispute and for additional funds totaling $45,000 to complete a pathway along the Intracoastal Waterway and a gazebo/ fishing pier on the North Point in off Longview Way. 
 
The parcels involved are a 20 foot strip of land that runs parallel to lots 37 through 44 along the Cimarron Waterway and a 100 to 150 foot wide strip that runs parallel to lots 1 through 36 along the Intracoastal Waterway.
 
Up until now, Tidelands property owners along the Cimmaron Canal and the Intracoastal Waterway did not have dock rights, although they are on the water.  The return of these common areas to the Tidelands Home Owners Association paves the way for affected property owners to purchase an easement right of way (from the HOA) across the common area to the waterfront.  
 
The HOA will continue to own all of the common areas. Property owners will be limited to one dock per home. Cost to home owners for the easement right of way across the HOA property will range from $10,000 -$14,000 with a substantial early payment incentive which amounts to a 50% discount. Effected property owners will have until October 23, 2009 to purchase their right of way and enjoy the discount. 
 
According to Association President John Loudermilk, “The plan is projected to raise at least $200,000 to support the Common Area Use Committee plan for beautification starting at the North Point with a coquina shore line, gazebo, fishing pier, picnic area, seating, and a pathway connecting the North Point to the Tidelands Phase-II existing pathway. Although it is not a mandatory requirement for any member/ home owner to purchase the “easement right of way” it is expected from discussions that many will sign up for this option. As the economy starts to recover and people start building again, we expect to have most of these options. That will add several hundred thousand dollars more to our HOA reserves”.
 
Home owners not located on the water, who want a dock, will be able to purchase in the Tidelands Phase-II Condo area in the future. It is not known when those boat slips will be available for sale. 
 
Unclear at this point is the disposition of fees previously paid by property owners to Centex presumably as down payment toward waterfront access. According to Mr. Loudermilk, that issue is between the individual owners and Centex. 
 
Centex was recently purchased by Pulte Homes.

    Features Returned

    Firsty, that is good news to hear about their dock access.
    So, Dear Toby, do you know if the’Boat to Golf Dock’ feature at the Palm Harbor Golf course will be returned. Yesterday we saw the demolition of the *Marker* sign and the entire Clubhouse Driveway. No one there knew if the ‘Boat to Golf Dock ‘ feature will be returned to us, do you know?

    From what I understand, Centex hasn’t signed the agreement yet. It’s not a done deal. Plus, how long is it going to take to get those docks permitted and how much will it cost? Doesn’t seem like there is clear cut winner here.

    THE CHECK FROM CENTEX IS IN THE BANK. I HARDLY THINK THEY WOULD HAVE ISSUED THAT PAYMENT WITHOUT AN AGREEMENT BEING REACHED AND SIGNED OFF ON.
    TO THOSE WHO HAVE HAD ACCESS TO YOUR DOCKS AND BOATS. NOW THE REST OF US PERHAPS, CAN ENJOY OUR WONDERFUL COMMUNITY JUST A LITTLE BIT MORE.
